LIMAR USA - Minimum Advertised Price Policy

Effective May 1, 2015
LIMAR is a manufacturer of premium helmets and eyewear products for cyclists. LIMAR has, throughout its history, established a strong brand reputation for making high-quality products. To protect such reputation, LIMAR has decided to establish a Minimum Advertised Price (MAP) Policy for its products, which must be adhered to by all sellers offering LIMAR products.. LIMAR unilaterally agrees to allow retailers to offer its products for sale via a physical storefront or on the internet, upon the following conditions:

1) Sellers that advertise LIMAR products prices below the MAP indicated in the attached LIMAR’s current price sheet, will be in violation of LIMAR’s MAP policy. Retailers in violation of LIMAR’s MAP policy will be in jeopardy of losing the right to sell LIMAR product, and will forfeit any program pricing it enjoys via LIMAR’ master distributors, as well as any Grassroots or Shop Race Team benefits it may have been entitled to. Dealers in violation of LIMAR’s MAP policy will be invoiced at single-unit pricing for any helmets it previously purchased through pre-season programs.

2) For purposes of this policy, “advertising” refers to any means by which an end consumer may see pricing for LIMAR product, including, but not limited to, internet, in-store signage, or any published advertising via any media.

3) Any advertising that suggests a price lower than MAP price will be considered a violation of LIMAR’s MAP policy. Free shipping or tax rebates are NOT considered a violation of LIMAR’s MAP policy, and are allowed at the discretion of the seller.

4) LIMAR may amend its MAP policy from time to time at its discretion, allowing certain models exemption from its MAP policy for purposes of inventory reduction, closeout, or style changes.

5) No employee or contractor of LIMAR may make any substitutions of changes to its MAP policy at any time, and any attempts of any LIMAR employee to attempt to enact any changes to LIMAR’s MAP policy are invalid.

6) No part of LIMAR’s MAP policy are intended for sellers to sell LIMAR product at strictly its Minimum Advertised Price, and LIMAR makes no suggestion to this effect.
